มาตรา 205 ถ้าการกระทำดังกล่าวในมาตรา 204 เป็นการกระทำโดยประมาท ผู้กระทำต้องระวางโทษจำคุกไม่เกินสองปี หรือปรับไม่เกินสี่หมื่นบาท หรือทั้งจำทั้งปรับ
ถ้าผู้ที่หลุดพ้นจากการคุมขังไปด้วยการกระทำโดยประมาทนั้น เป็นบุคคลที่ต้องคำพิพากษาของศาลหนึ่งศาลใดให้ลงโทษประหารชีวิต จำคุกตลอดชีวิต หรือจำคุกตั้งแต่สิบห้าปีขึ้นไป หรือมีจำนวนตั้งแต่สามคนขึ้นไป ผู้กระทำต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินหกหมื่นบาท หรือทั้งจำทั้งปรับ
ถ้าผู้กระทำความผิด จัดให้ได้ตัวผู้ที่หลุดพ้นจากการคุมขังคืนมาภายในสามเดือน ให้งดการลงโทษแก่ผู้กระทำความผิดนั้น
Section 205 If the act under Section 204 is committed negligently, the doer shall be liable to imprisonment not exceeding two years, or a fine not exceeding forty thousand baht, or both.
If the person freed by such negligence was sentenced by any court to death, imprisonment for life, or imprisonment of fifteen years or more, or there are three or more such persons, the doer shall be liable to imprisonment not exceeding three years, or a fine not exceeding sixty thousand baht, or both.
If the offender procures the return of the person freed within three months, the punishment shall be remitted.
