มาตรา 238 ถ้าการกระทำความผิดตามมาตรา 226 ถึงมาตรา 237 เป็นเหตุให้บุคคลอื่นถึงแก่ความตาย ผู้กระทำต้องระวางโทษจำคุกตลอดชีวิต หรือจำคุกตั้งแต่ห้าปีถึงยี่สิบปี และปรับตั้งแต่หนึ่งแสนบาทถึงสี่แสนบาท
ถ้าเป็นเหตุให้บุคคลอื่นรับอันตรายสาหัส ผู้กระทำต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงสิบปี และปรับตั้งแต่สองหมื่นบาทถึงสองแสนบาท
Section 238 If the offence under Sections 226 to 237 causes the death of another person, the doer shall be liable to imprisonment for life or imprisonment of five to twenty years and a fine of one hundred thousand to four hundred thousand baht.
If it causes grievous bodily harm to another person, the doer shall be liable to imprisonment of one to ten years and a fine of twenty thousand to two hundred thousand baht.
