มาตรา 42 ในการคำนวณระยะเวลากักกัน ให้นับวันที่ศาลพิพากษาเป็นวันเริ่มกักกัน แต่ถ้ายังมีโทษจำคุกหรือกักขังที่ผู้ต้องกักกันนั้นจะต้องรับอยู่ก็ให้จำคุกหรือกักขังเสียก่อนและให้นับวันถัดจากวันที่พ้นโทษจำคุก หรือพ้นจากกักขังเป็นวันเริ่มกักกัน

ระยะเวลากักกัน และการปล่อยตัวผู้ถูกกักกัน ให้นำบทบัญญัติมาตรา 21 มาใช้บังคับโดยอนุโลม

Section 42 In calculating the period of confinement, the day of the judgment is counted as the first day of confinement; but if the person still has imprisonment or confinement (gak-khang) to undergo, the imprisonment or confinement shall be served first, and the day following release from it shall be the first day of habitual-offender confinement.

For the period of confinement and the release of the person confined, Section 21 shall apply mutatis mutandis.
