มาตรา 5 ความผิดใดที่การกระทำแม้แต่ส่วนหนึ่งส่วนใดได้กระทำในราชอาณาจักรก็ดี ผลแห่งการกระทำเกิดในราชอาณาจักรโดยผู้กระทำประสงค์ให้ผลนั้นเกิดในราชอาณาจักร หรือโดยลักษณะแห่งการกระทำ ผลที่เกิดขึ้นนั้นควรเกิดในราชอาณาจักรหรือย่อมจะเล็งเห็นได้ว่าผลนั้นจะเกิดในราชอาณาจักรก็ดี ให้ถือว่าความผิดนั้นได้กระทำในราชอาณาจักร
ในกรณีการตระเตรียมการ หรือพยายามกระทำการใดซึ่งกฎหมายบัญญัติเป็นความผิด แม้การกระทำนั้นจะได้กระทำนอกราชอาณาจักร ถ้าหากการกระทำนั้นจะได้กระทำตลอดไปจนถึงขั้นความผิดสำเร็จ ผลจะเกิดขึ้นในราชอาณาจักร ให้ถือว่า การตระเตรียมการหรือพยายามกระทำความผิดนั้นได้กระทำในราชอาณาจักร
Section 5 Any offence of which even a part of the act is done within the Kingdom, or the result of which occurs within the Kingdom where the doer intended that result to occur within the Kingdom, or where, by the nature of the act, the result ought to occur within the Kingdom or could be foreseen to occur within the Kingdom, shall be deemed committed within the Kingdom.
Where there is preparation or an attempt to do any act that the law provides to be an offence, even though that act is done outside the Kingdom, if, had the act been carried through to completion, the result would occur within the Kingdom, the preparation or attempt shall be deemed committed within the Kingdom.
