มาตรา 54 ในการคำนวณการเพิ่มโทษหรือลดโทษที่จะลง ให้ศาลตั้งกำหนดโทษที่จะลงแก่จำเลยเสียก่อนแล้วจึงเพิ่มหรือลด ถ้ามีทั้งการเพิ่มและการลดโทษที่จะลง ให้เพิ่มก่อนแล้วจึงลดจากผลที่เพิ่มแล้วนั้น ถ้าส่วนของการเพิ่มเท่ากับหรือมากกว่าส่วนของการลด และศาลเห็นสมควรจะไม่เพิ่มไม่ลดก็ได้
Section 54 In calculating an increase or a reduction of the punishment to be imposed, the court shall first fix the punishment to be imposed on the defendant and then increase or reduce it. If there is both an increase and a reduction of the punishment, the increase shall be made first and the reduction then made from the increased result. If the portion of the increase equals or exceeds the portion of the reduction, the court may, if it sees fit, neither increase nor reduce.
