มาตรา 122 ผู้ใดกระทำการใด ๆ เพื่ออุปการะแก่การดำเนินการรบหรือการตระเตรียมการรบของข้าศึก ต้องระวางโทษจำคุกตั้งแต่ห้าปีถึงสิบห้าปี
ถ้าการอุปการะนั้นเป็นการ
(1) ทำให้ป้อม ค่าย สนามบิน ยานรบ ยานพาหนะ ทางคมนาคม สิ่งที่ใช้ในการสื่อสาร ยุทธภัณฑ์ เสบียงอาหาร อู่เรือ อาคาร หรือสิ่งอื่นใดสำหรับใช้เพื่อการสงครามใช้การไม่ได้หรือตกไปอยู่ในเงื้อมมือของข้าศึก
(2) ยุยงทหารให้ละเลยไม่กระทำการตามหน้าที่ ก่อการกำเริบ หนีราชการหรือละเมิดวินัย
(3) กระทำจารกรรม นำหรือแนะทางให้ข้าศึก หรือ
(4) กระทำโดยประการอื่นใดให้ข้าศึกได้เปรียบในการรบ
ผู้กระทำต้องระวางโทษประหารชีวิต หรือจำคุกตลอดชีวิต
Section 122 Whoever does any act to support the conduct or preparation of war by the enemy shall be liable to imprisonment of five to fifteen years.
If the support consists of:
(1) rendering a fort, camp, airfield, war vehicle, vehicle, line of communication, means of communication, munitions, provisions, dockyard, building, or any other thing for use in war unusable or fallen into the enemy's hands;
(2) inciting soldiers to neglect their duty, to mutiny, to desert, or to breach discipline;
(3) committing espionage, leading or guiding the enemy; or
(4) by any other means giving the enemy an advantage in war;
the doer shall be liable to death or imprisonment for life.
