มาตรา 323 ผู้ใดล่วงรู้หรือได้มาซึ่งความลับของผู้อื่นโดยเหตุที่เป็นเจ้าพนักงานผู้มีหน้าที่ โดยเหตุที่ประกอบอาชีพเป็นแพทย์ เภสัชกร คนจำหน่ายยา นางผดุงครรภ์ ผู้พยาบาล นักบวช หมอความ ทนายความ หรือผู้สอบบัญชีหรือโดยเหตุที่เป็นผู้ช่วยในการประกอบอาชีพนั้นแล้วเปิดเผยความลับนั้นในประการที่น่าจะเกิดความเสียหายแก่ผู้หนึ่งผู้ใด ต้องระวางโทษจำคุกไม่เกินหกเดือน หรือปรับไม่เกินหนึ่งหมื่นบาท หรือทั้งจำทั้งปรับ
ผู้รับการศึกษาอบรมในอาชีพดังกล่าวในวรรคแรก เปิดเผยความลับของผู้อื่น อันตนได้ล่วงรู้หรือได้มาในการศึกษาอบรมนั้น ในประการที่น่าจะเกิดความเสียหายแก่ผู้หนึ่งผู้ใด ต้องระวางโทษเช่นเดียวกัน
Section 323 Whoever learns or comes to possess the secret of another by reason of being an official with a duty, or by reason of the profession of physician, pharmacist, druggist, midwife, nurse, clergyman, legal advisor, lawyer, or auditor, or by being an assistant in such profession, and discloses that secret in a manner likely to cause harm to any person, shall be liable to imprisonment not exceeding six months, or a fine not exceeding ten thousand baht, or both.
A person undergoing training in such a profession who discloses a secret of another learned or obtained in that training, in a manner likely to cause harm to any person, shall be liable to the same punishment.
