มาตรา 40 กักกัน คือการควบคุมผู้กระทำความผิดติดนิสัยไว้ภายในเขตกำหนด เพื่อป้องกันการกระทำความผิด เพื่อดัดนิสัย และเพื่อฝึกหัดอาชีพ
Section 40 Confinement for habitual offenders (kakkan) is the control of a habitual offender within a designated zone, to prevent the commission of offences, to reform his disposition, and to train him in an occupation.
