มาตรา 313 ผู้ใดเพื่อให้ได้มาซึ่งค่าไถ่
(1) เอาตัวเด็กอายุไม่เกินสิบห้าปีไป
(2) เอาตัวบุคคลอายุกว่าสิบห้าปีไป โดยใช้อุบายหลอกลวง ขู่เข็ญ ใช้กำลังประทุษร้าย ใช้อำนาจครอบงำผิดคลองธรรม หรือใช้วิธีข่มขืนใจด้วยประการอื่นใด หรือ
(3) หน่วงเหนี่ยวหรือกักขังบุคคลใด
ต้องระวางโทษจำคุกตั้งแต่สิบห้าปีถึงยี่สิบปี และปรับตั้งแต่สามแสนบาทถึงสี่แสนบาท หรือจำคุกตลอดชีวิต หรือประหารชีวิต
ถ้าการกระทำความผิดตามวรรคแรกเป็นเหตุให้ผู้ถูกเอาตัวไป ผู้ถูกหน่วงเหนี่ยว หรือผู้ถูกกักขังนั้นรับอันตรายสาหัส หรือเป็นการกระทำโดยทรมาน หรือโดยทารุณโหดร้าย จนเป็นเหตุให้ผู้ถูกกระทำนั้นรับอันตรายแก่กาย หรือจิตใจ ผู้กระทำต้องระวางโทษประหารชีวิต หรือจำคุกตลอดชีวิต
ถ้าการกระทำความผิดนั้นเป็นเหตุให้ผู้ถูกเอาตัวไป ผู้ถูกหน่วงเหนี่ยว หรือผู้ถูกกักขังนั้นถึงแก่ความตาย ผู้กระทำต้องระวางโทษประหารชีวิต
Section 313 Whoever, in order to obtain a ransom:
(1) takes away a child not over fifteen years of age;
(2) takes away a person over fifteen years of age by deceitful trickery, threat, use of force, undue moral influence, or any other means of coercion; or
(3) detains or confines any person;
shall be liable to imprisonment of fifteen to twenty years and a fine of three hundred thousand to four hundred thousand baht, or imprisonment for life, or death.
If the offence under paragraph one causes the person taken away, detained, or confined to suffer grievous bodily harm, or is committed by torture or cruelty causing bodily or mental harm, the offender shall be liable to death or imprisonment for life.
If the offence causes the person taken away, detained, or confined to die, the offender shall be liable to death.
