มาตรา 359 ถ้าการกระทำความผิดตามมาตรา 358 ได้กระทำต่อ
(1) เครื่องกลหรือเครื่องจักรที่ใช้ในการประกอบกสิกรรมหรืออุตสาหกรรม
(2) ปศุสัตว์
(3) ยวดยานหรือสัตว์พาหนะที่ใช้ในการขนส่งสาธารณะหรือในการประกอบกสิกรรมหรืออุตสาหกรรม หรือ
(4) พืชหรือพืชผลของกสิกร
ผู้กระทำต้องระวางโทษจำคุกไม่เกินห้าปี หรือปรับไม่เกินหนึ่งแสนบาท หรือทั้งจำทั้งปรับ
Section 359 If the offence under Section 358 is committed against:
(1) machinery or mechanical equipment used in agriculture or industry;
(2) livestock;
(3) a vehicle or draught animal used in public transport or in agriculture or industry; or
(4) plants or produce of an agriculturist,
the offender shall be liable to imprisonment not exceeding five years or a fine not exceeding one hundred thousand baht, or both.

It remains a compoundable offence under Section 361.
