มาตรา 88 ถ้าความผิดที่ได้ใช้ ที่ได้โฆษณาหรือประกาศแก่บุคคลทั่วไปให้กระทำ หรือที่ได้สนับสนุนให้กระทำ ได้กระทำถึงขั้นลงมือกระทำความผิด แต่เนื่องจากการเข้าขัดขวางของผู้ใช้ ผู้โฆษณาหรือประกาศ หรือผู้สนับสนุน ผู้กระทำได้กระทำไปไม่ตลอด หรือกระทำไปตลอดแล้ว แต่การกระทำนั้นไม่บรรลุผล ผู้ใช้หรือผู้โฆษณาหรือประกาศ คงรับผิดเพียงที่บัญญัติไว้ในมาตรา 84 วรรคสอง หรือมาตรา 85 วรรคแรก แล้วแต่กรณี ส่วนผู้สนับสนุนนั้นไม่ต้องรับโทษ
Section 88 If the offence instigated, publicly incited, or supported reaches the stage of commencement of commission, but because of the intervention of the instigator, the person who publicly incited, or the supporter, the offender does not carry it through, or carries it through but the act does not achieve its result, the instigator or the person who publicly incited shall be liable only as provided in Section 84 paragraph two, or Section 85 paragraph one, as the case may be; and the supporter shall not be punished.
