มาตรา 82 ผู้ใดพยายามกระทำความผิด หากยับยั้งเสียเองไม่กระทำการให้ตลอด หรือกลับใจแก้ไขไม่ให้การกระทำนั้นบรรลุผล ผู้นั้นไม่ต้องรับโทษสำหรับการพยายามกระทำความผิดนั้น แต่ถ้าการที่ได้กระทำไปแล้วต้องตามบทกฎหมายที่บัญญัติเป็นความผิด ผู้นั้นต้องรับโทษสำหรับความผิดนั้น ๆ

Section 82 Whoever attempts to commit an offence but, of one's own accord, desists from carrying it through, or changes one's mind and prevents the act from achieving its result, shall not be punished for that attempt. But if what has already been done itself constitutes an offence under any provision of law, the offender shall be liable for that offence.

มาตรา 82 เป็นเหตุยกเว้นโทษเฉพาะ 'การพยายาม' เมื่อผู้กระทำสมัครใจยับยั้งไม่ทำต่อให้ตลอด หรือกลับใจแก้ไขจนผลไม่เกิด กฎหมายให้รางวัลโดยไม่ลงโทษฐานพยายาม หลักสำคัญคือต้องเป็น 'ใจสมัคร' ของผู้กระทำเอง หากหยุดเพราะถูกจับได้/ถูกขัดขวาง/กลัวถูกจับ ไม่ใช่การยับยั้งตาม ม.82 อนึ่ง หากการที่ทำไปแล้วก่อนยับยั้งครบองค์ประกอบความผิดอื่นในตัวเอง (เช่น ทำร้ายร่างกายไปแล้วก่อนกลับใจไม่ฆ่า) ผู้กระทำยังต้องรับโทษสำหรับความผิดที่สำเร็จไปแล้วนั้น

Section 82 is a ground for exemption from the 'attempt' penalty where the actor voluntarily desists from carrying it through, or changes their mind and prevents the result; the law rewards this by not punishing the attempt. The key is that it must be of the actor's 'own accord' — stopping because of being caught / prevented / fear of arrest is not desistance under Section 82. Moreover, if what was already done before desisting itself constitutes another offence (e.g., assault already inflicted before deciding not to kill), the actor is still punished for that completed offence.
