มาตรา 8 ผู้ใดกระทำความผิดนอกราชอาณาจักร และ
(ก) ผู้กระทำความผิดนั้นเป็นคนไทย และรัฐบาลแห่งประเทศที่ความผิดได้เกิดขึ้น หรือผู้เสียหายได้ร้องขอให้ลงโทษ หรือ
(ข) ผู้กระทำความผิดนั้นเป็นคนต่างด้าว และรัฐบาลไทยหรือคนไทยเป็นผู้เสียหาย และผู้เสียหายได้ร้องขอให้ลงโทษ
ถ้าความผิดนั้นเป็นความผิดดังระบุไว้ต่อไปนี้ จะต้องรับโทษภายในราชอาณาจักร คือ
(1) ความผิดเกี่ยวกับการก่อให้เกิดภยันตรายต่อประชาชน ตามที่บัญญัติไว้ในมาตรา 217 มาตรา 218 มาตรา 221 ถึงมาตรา 223 ทั้งนี้ เว้นแต่กรณีเกี่ยวกับมาตรา 220 วรรคแรก และมาตรา 224 มาตรา 226 มาตรา 228 ถึงมาตรา 232 มาตรา 237 และมาตรา 233 ถึงมาตรา 236 ทั้งนี้ เฉพาะเมื่อเป็นกรณีต้องระวางโทษตามมาตรา 238
(2) ความผิดเกี่ยวกับเอกสาร ตามที่บัญญัติไว้ในมาตรา 264 มาตรา 265 มาตรา 266 (1) และ (2) มาตรา 268 ทั้งนี้ เว้นแต่กรณีเกี่ยวกับมาตรา 267 และมาตรา 269
(2/1) ความผิดเกี่ยวกับบัตรอิเล็กทรอนิกส์ตามที่บัญญัติไว้ในมาตรา 269/1 ถึงมาตรา 269/7
(2/2) ความผิดเกี่ยวกับหนังสือเดินทางตามที่บัญญัติไว้ในมาตรา 269/8 ถึงมาตรา 269/15
(3) ความผิดเกี่ยวกับเพศ ตามที่บัญญัติไว้ในมาตรา 276 มาตรา 280 และมาตรา 285 ทั้งนี้ เฉพาะที่เกี่ยวกับมาตรา 276
(4) ความผิดต่อชีวิต ตามที่บัญญัติไว้ในมาตรา 288 ถึงมาตรา 290
(5) ความผิดต่อร่างกาย ตามที่บัญญัติไว้ในมาตรา 295 ถึงมาตรา 298
(6) ความผิดฐานทอดทิ้งเด็ก คนป่วยเจ็บหรือคนชรา ตามที่บัญญัติไว้ในมาตรา 306 ถึงมาตรา 308
(7) ความผิดต่อเสรีภาพ ตามที่บัญญัติไว้ในมาตรา 309 มาตรา 310 มาตรา 312 ถึงมาตรา 315 และมาตรา 317 ถึงมาตรา 320
(8) ความผิดฐานลักทรัพย์และวิ่งราวทรัพย์ ตามที่บัญญัติไว้ในมาตรา 334 ถึงมาตรา 336
(9) ความผิดฐานกรรโชก รีดเอาทรัพย์ ชิงทรัพย์ และปล้นทรัพย์ ตามที่บัญญัติไว้ในมาตรา 337 ถึงมาตรา 340
(10) ความผิดฐานฉ้อโกง ตามที่บัญญัติไว้ในมาตรา 341 ถึงมาตรา 344 มาตรา 346 และมาตรา 347
(11) ความผิดฐานยักยอก ตามที่บัญญัติไว้ในมาตรา 352 ถึงมาตรา 354
(12) ความผิดฐานรับของโจร ตามที่บัญญัติไว้ในมาตรา 357
(13) ความผิดฐานทำให้เสียทรัพย์ ตามที่บัญญัติไว้ในมาตรา 358 ถึงมาตรา 360
Section 8 Whoever commits an offence outside the Kingdom, where:
(a) the offender is a Thai national and the government of the country in which the offence occurred, or the injured person, has requested punishment; or
(b) the offender is an alien and the Thai Government or a Thai national is the injured person, and the injured person has requested punishment;
shall be punished within the Kingdom if the offence is one of the following:
(1) offences of causing danger to the public, under Sections 217, 218, 221 to 223 (except the case concerning Section 220 paragraph one), and 224, 226, 228 to 232, 237, and 233 to 236 (only where the case is punishable under Section 238);
(2) offences relating to documents, under Sections 264, 265, 266 (1) and (2), and 268 (except the case concerning Sections 267 and 269);
(2/1) offences relating to electronic cards, under Sections 269/1 to 269/7;
(2/2) offences relating to passports, under Sections 269/8 to 269/15;
(3) offences relating to sexuality, under Sections 276, 280, and 285 (only as concerns Section 276);
(4) offences against life, under Sections 288 to 290;
(5) offences against the body, under Sections 295 to 298;
(6) the offence of abandoning a child, sick, or aged person, under Sections 306 to 308;
(7) offences against liberty, under Sections 309, 310, 312 to 315, and 317 to 320;
(8) the offences of theft and snatching, under Sections 334 to 336;
(9) the offences of extortion, blackmail, robbery, and gang-robbery, under Sections 337 to 340;
(10) the offence of fraud, under Sections 341 to 344, 346, and 347;
(11) the offence of misappropriation, under Sections 352 to 354;
(12) the offence of receiving stolen property, under Section 357;
(13) the offence of mischief, under Sections 358 to 360.
