มาตรา 1 ในประมวลกฎหมายนี้
(1) “โดยทุจริต” หมายความว่า เพื่อแสวงหาประโยชน์ที่มิควรได้โดยชอบด้วยกฎหมายสำหรับตนเองหรือผู้อื่น
(2) “ทางสาธารณะ” หมายความว่า ทางบกหรือทางน้ำสำหรับประชาชนใช้ในการจราจร และให้หมายความรวมถึงทางรถไฟและทางรถรางที่มีรถเดิน สำหรับประชาชนโดยสารด้วย
(3) “สาธารณสถาน” หมายความว่า สถานที่ใด ๆ ซึ่งประชาชนมีความชอบธรรมที่จะเข้าไปได้
(4) “เคหสถาน” หมายความว่า ที่ซึ่งใช้เป็นที่อยู่อาศัย เช่น เรือน โรง เรือ หรือแพ ซึ่งคนอยู่อาศัย และให้หมายความรวมถึงบริเวณของที่ซึ่งใช้เป็นที่อยู่อาศัยนั้นด้วย จะมีรั้วล้อมหรือไม่ก็ตาม
(5) “อาวุธ” หมายความรวมถึงสิ่งซึ่งไม่เป็นอาวุธโดยสภาพ แต่ซึ่งได้ใช้หรือเจตนาจะใช้ประทุษร้ายร่างกายถึงอันตรายสาหัสอย่างอาวุธ
(6) “ใช้กำลังประทุษร้าย” หมายความว่า ทำการประทุษร้ายแก่กายหรือจิตใจของบุคคล ไม่ว่าจะทำด้วยใช้แรงกายภาพหรือด้วยวิธีอื่นใด และให้หมายความรวมถึงการกระทำใด ๆ ซึ่งเป็นเหตุให้บุคคลหนึ่งบุคคลใดอยู่ในภาวะที่ไม่สามารถขัดขืนได้ ไม่ว่าจะโดยใช้ยาทำให้มึนเมา สะกดจิต หรือใช้วิธีอื่นใดอันคล้ายคลึงกัน
(7) “เอกสาร” หมายความว่า กระดาษหรือวัตถุอื่นใดซึ่งได้ทำให้ปรากฏความหมายด้วยตัวอักษร ตัวเลข ผัง หรือแผนแบบอย่างอื่น จะเป็นโดยวิธีพิมพ์ ถ่ายภาพ หรือวิธีอื่นอันเป็นหลักฐานแห่งความหมายนั้น
(8) “เอกสารราชการ” หมายความว่า เอกสารซึ่งเจ้าพนักงานได้ทำขึ้นหรือรับรองในหน้าที่ และให้หมายความรวมถึงสำเนาเอกสารนั้น ๆ ที่เจ้าพนักงานได้รับรองในหน้าที่ด้วย
(9) “เอกสารสิทธิ” หมายความว่า เอกสารที่เป็นหลักฐานแห่งการก่อ เปลี่ยนแปลง โอน สงวนหรือระงับซึ่งสิทธิ
(10) “ลายมือชื่อ” หมายความรวมถึงลายพิมพ์นิ้วมือและเครื่องหมายซึ่งบุคคลลงไว้แทนลายมือชื่อของตน
(11) “กลางคืน” หมายความว่า เวลาระหว่างพระอาทิตย์ตกและพระอาทิตย์ขึ้น
(12) “คุมขัง” หมายความว่า คุมตัว ควบคุม ขัง กักขังหรือจำคุก
(13) “ค่าไถ่” หมายความว่า ทรัพย์สินหรือประโยชน์ที่เรียกเอา หรือให้เพื่อแลกเปลี่ยนเสรีภาพของผู้ถูกเอาตัวไป ผู้ถูกหน่วงเหนี่ยวหรือผู้ถูกกักขัง
(14) “บัตรอิเล็กทรอนิกส์” หมายความว่า
(ก) เอกสารหรือวัตถุอื่นใดไม่ว่าจะมีรูปลักษณะใดที่ผู้ออกได้ออกให้แก่ผู้มีสิทธิใช้ ซึ่งจะระบุชื่อหรือไม่ก็ตาม โดยบันทึกข้อมูลหรือรหัสไว้ด้วยการประยุกต์ใช้วิธีการทางอิเล็กตรอน ไฟฟ้า คลื่นแม่เหล็กไฟฟ้า หรือวิธีอื่นใดในลักษณะคล้ายกัน ซึ่งรวมถึงการประยุกต์ใช้วิธีการทางแสงหรือวิธีการทางแม่เหล็กให้ปรากฏความหมายด้วยตัวอักษร ตัวเลข รหัส หมายเลขบัตร หรือสัญลักษณ์อื่นใด ทั้งที่สามารถมองเห็นและมองไม่เห็นด้วยตาเปล่า
(ข) ข้อมูล รหัส หมายเลขบัญชี หมายเลขชุดทางอิเล็กทรอนิกส์หรือเครื่องมือทางตัวเลขใด ๆ ที่ผู้ออกได้ออกให้แก่ผู้มีสิทธิใช้ โดยมิได้มีการออกเอกสารหรือวัตถุอื่นใดให้ แต่มีวิธีการใช้ในทำนองเดียวกับ (ก) หรือ
(ค) สิ่งอื่นใดที่ใช้ประกอบกับข้อมูลอิเล็กทรอนิกส์เพื่อแสดงความสัมพันธ์ระหว่างบุคคลกับข้อมูลอิเล็กทรอนิกส์ โดยมีวัตถุประสงค์เพื่อระบุตัวบุคคลผู้เป็นเจ้าของ
(15) “หนังสือเดินทาง” หมายความว่า เอกสารสำคัญประจำตัวไม่ว่าจะมีรูปลักษณะใดที่รัฐบาลไทย รัฐบาลต่างประเทศ หรือองค์การระหว่างประเทศออกให้แก่บุคคลใด เพื่อใช้แสดงตนในการเดินทางระหว่างประเทศ และให้หมายความรวมถึงเอกสารใช้แทนหนังสือเดินทางและแบบหนังสือเดินทางที่ยังไม่ได้กรอกข้อความเกี่ยวกับผู้ถือหนังสือเดินทางด้วย
(16) “เจ้าพนักงาน” หมายความว่า บุคคลซึ่งกฎหมายบัญญัติว่าเป็นเจ้าพนักงานหรือได้รับแต่งตั้งตามกฎหมายให้ปฏิบัติหน้าที่ราชการ ไม่ว่าเป็นประจำหรือครั้งคราว และไม่ว่าจะได้รับค่าตอบแทนหรือไม่
(17) “สื่อลามกอนาจารเด็ก” หมายความว่า วัตถุหรือสิ่งที่แสดงให้รู้หรือเห็นถึงการกระทำทางเพศของเด็กหรือกับเด็กซึ่งมีอายุไม่เกินสิบแปดปี โดยรูป เรื่อง หรือลักษณะสามารถสื่อไปในทางลามกอนาจาร ไม่ว่าจะอยู่ในรูปแบบของเอกสาร ภาพเขียน ภาพพิมพ์ ภาพระบายสี สิ่งพิมพ์ รูปภาพ ภาพโฆษณา เครื่องหมาย รูปถ่าย ภาพยนตร์ แถบบันทึกเสียง แถบบันทึกภาพ หรือรูปแบบอื่นใดในลักษณะทำนองเดียวกัน และให้หมายความรวมถึงวัตถุหรือสิ่งต่าง ๆ ข้างต้นที่จัดเก็บในระบบคอมพิวเตอร์หรือในอุปกรณ์อิเล็กทรอนิกส์อื่นที่สามารถแสดงผลให้เข้าใจความหมายได้
(18) “กระทำชำเรา” หมายความว่า กระทำเพื่อสนองความใคร่ของผู้กระทำ โดยการใช้อวัยวะเพศของผู้กระทำล่วงล้ำอวัยวะเพศ ทวารหนัก หรือช่องปากของผู้อื่น หรือการใช้อวัยวะอื่นของผู้กระทำหรือวัตถุล่วงล้ำอวัยวะเพศหรือทวารหนักของผู้อื่น หรือการให้ผู้อื่นกระทำกับผู้กระทำในลักษณะเดียวกัน แต่การให้ผู้อื่นกระทำการดังกล่าวนั้นไม่รวมถึงกรณีที่ผู้อื่นใช้อวัยวะอื่นหรือวัตถุล่วงล้ำอวัยวะเพศหรือทวารหนักของผู้กระทำ ทั้งนี้ อวัยวะเพศให้หมายความรวมถึงอวัยวะเพศจากการผ่าตัด
(19) “คุกคามทางเพศ” หมายความว่า กระทำโดยทางกาย วาจา การส่งเสียง การแสดงอากัปกิริยาหรือท่าทาง การติดต่อสื่อสาร การเฝ้าดู การติดตามรังควาน หรือกระทำด้วยประการใด ๆ รวมถึงกระทำด้วยระบบคอมพิวเตอร์ อุปกรณ์โทรคมนาคม หรืออุปกรณ์อิเล็กทรอนิกส์อื่นที่สามารถแสดงผลให้เข้าใจความหมายได้ ต่อผู้อื่น อันมีลักษณะส่อไปในทางเพศ โดยประการที่น่าจะทำให้ผู้อื่นนั้น เดือดร้อนรำคาญ อับอาย ถูกเหยียดหยาม หวาดกลัว หรือได้รับความไม่ปลอดภัยในทางเพศ
Section 1 In this Code:
(1) "Dishonestly" means in order to procure, for oneself or for another, a benefit to which one is not lawfully entitled.
(2) "Public way" means a way by land or water for the use of the public in travel, and includes a railway and a tramway operated for the carriage of the public.
(3) "Public place" means any place to which the public has a legitimate right of entry.
(4) "Dwelling place" means a place used as a residence, such as a house, building, vessel, or floating house in which persons live, and includes the precincts of such residence, whether or not enclosed by a fence.
(5) "Weapon" includes anything that is not a weapon by its nature but that has been used, or is intended to be used, to inflict bodily harm amounting to grievous harm, in the manner of a weapon.
(6) "To use force of violence" means to do violence to the body or mind of a person, whether by physical force or by any other means, and includes any act that puts a person in a condition of being unable to resist, whether by administering an intoxicant, by hypnosis, or by any other similar means.
(7) "Document" means paper or any other material on which meaning has been made to appear by letters, figures, plans, or any other design, whether by printing, photography, or any other means, that serves as evidence of such meaning.
(8) "Official document" means a document made or certified by an official in the course of duty, and includes a copy of such document certified by an official in the course of duty.
(9) "Document of title" means a document evidencing the creation, alteration, transfer, reservation, or extinction of a right.
(10) "Signature" includes a fingerprint and a mark a person affixes in place of his signature.
(11) "Night-time" means the period between sunset and sunrise.
(12) "To detain in custody" means to take into custody, to control, to confine, to keep in confinement, or to imprison.
(13) "Ransom" means property or a benefit demanded or given in exchange for the liberty of a person who has been taken away, held, or confined.
(14) "Electronic card" means:
(a) a document or any other thing, of whatever form, that an issuer issues to a person entitled to use it, whether or not it bears a name, by recording data or a code through the application of electronic, electrical, electromagnetic, or any similar means — including the application of optical or magnetic means — so as to make meaning appear by letters, figures, codes, a card number, or any other symbol, whether or not visible to the naked eye;
(b) data, a code, an account number, an electronic series number, or any numerical device that an issuer issues to a person entitled to use it without issuing any document or other thing, but that is used in a manner similar to (a); or
(c) anything else used together with electronic data to show the relationship between a person and the electronic data, for the purpose of identifying the person who is the owner.
(15) "Passport" means an identity document of importance, of whatever form, issued by the Thai Government, a foreign government, or an international organization to a person for use in identifying himself in international travel, and includes a document used in place of a passport and a passport form not yet filled in with particulars of the holder.
(16) "Official" means a person whom the law provides to be an official, or who is appointed under the law to perform an official function, whether permanently or occasionally, and whether or not remunerated.
(17) "Child pornography" means material or a thing depicting or showing the sexual act of, or with, a child not over eighteen years of age, whose image, story, or character can convey obscenity, whether in the form of a document, drawing, print, painting, publication, picture, advertisement, mark, photograph, film, sound recording, video recording, or any other similar form, and includes such material or things stored in a computer system or in another electronic device capable of displaying them so as to be understood.
(18) "Sexual intercourse" means an act done to gratify the sexual desire of the doer by using the doer's sexual organ to penetrate the sexual organ, anus, or mouth of another, or by using another organ of the doer or an object to penetrate the sexual organ or anus of another, or by having another do likewise to the doer; but having another do such act does not include the case where the other uses another organ or an object to penetrate the sexual organ or anus of the doer. For this purpose, "sexual organ" includes a sexual organ created by surgery.
(19) "Sexual harassment" means an act done — by body, word, sound, gesture or bearing, communication, watching, stalking and harassing, or by any means, including by means of a computer system, telecommunications equipment, or another electronic device capable of conveying meaning — toward another, of a sexual character, in a manner likely to cause that other person annoyance, embarrassment, humiliation, fear, or sexual insecurity.
